## 4. 最终用途声明 / End-Use Declaration

签字人作为第 1 节所述进口商的合法授权代表,特此声明并证明如下:

The undersigned, as the legally authorized representative of the importer named in Section 1, hereby declares and certifies the following:

### 4.1 民用商业用途 / Civilian Commercial Use Only

上述材料**仅用于民用商业用途**,包括但不限于:

These materials will be used **exclusively for civilian commercial purposes**, including but not limited to:

- 民用防护背包及个人随身用品 / Civilian protective backpacks and personal carry items
- 民用插板套及个人防护内胆袋 / Civilian plate carriers and insert pouches for personal protection
- 户外用品、箱包、行李及战术风格民用消费品(面向民用与执法采购市场) / Outdoor gear, bags, luggage, and tactical-style consumer products for the civilian and law-enforcement market
- 工业填充、包装、缓冲应用 / Industrial padding, packaging, and cushioning applications
- 运动用品及休闲装备 / Sporting goods and recreational equipment

### 4.2 禁止用途 / Prohibited End Uses

上述材料**不得用于** / These materials **shall NOT be used for**:

- 任何军用武器系统或武器平台 / Any military weapon system or weapon platform
- 为武装部队采购而生产或组装军用防弹衣 / Manufacturing or assembly of military body armor for armed forces procurement
- 销售或转移给美国财政部 OFAC SDN 名单上的任何方 / Sale or transfer to any party on the U.S. Treasury OFAC SDN list
- 销售或转移给美国商务部 Entity List 或 Denied Persons List 上的任何方 / Sale or transfer to any party on the U.S. Commerce Entity List or Denied Persons List
- 再出口或转运至受禁运国家(古巴、伊朗、朝鲜、叙利亚、俄罗斯、白俄罗斯,或其他受全面制裁国家) / Re-export to embargoed countries (Cuba, Iran, North Korea, Syria, Russia, Belarus, or other comprehensively sanctioned countries)
- 大规模杀伤性武器(WMD)、导弹或核/化/生武器相关应用 / Production of WMD, missiles, or nuclear/chemical/biological weapons-related applications

### 4.3 最终用户证明 / End User Certification

第 1 节所列最终用户 / The end user identified in Section 1:

## 5. 合规义务 / Compliance Acknowledgments

### 5.1 美国海关合规 / U.S. Customs Compliance

最终用户确认承担以下责任 / The end user acknowledges responsibility for:

- 向美国海关与边境保护局(CBP)申报准确的报关信息 / Filing accurate entry summary documentation with CBP
- 缴纳所有适用关税,包括 Section 301 关税(如适用)及 IEEPA 相关税费 / Paying all applicable duties, including Section 301 tariffs and IEEPA-related fees
- 按照 19 CFR § 163 保留进口记录不少于 5 年 / Maintaining all import records for not less than 5 years per 19 CFR § 163

### 5.2 再出口合规 / Re-Export Compliance

最终用户确认 / The end user acknowledges:

- 上述材料从美国再出口可能受美国 EAR 管辖 / These materials may be subject to U.S. EAR upon any re-export from the United States
- 任何再出口(即使是含有上述材料的成品)都必须符合所有适用的美国出口管制 / Any re-export, even of finished goods, must comply with all applicable U.S. export controls
- 最终用户将在再出口前取得任何所需的美国出口许可 / The end user will obtain any required U.S. export licenses before re-exporting

### 5.3 不转移声明 / No Diversion

最终用户证明上述材料不会被转移至任何违反美国法律的未授权最终用途、最终用户或目的地。

The end user certifies that these materials will not be diverted to any unauthorized end use, end user, or destination contrary to U.S. law.

## 7. 出口商内部备案说明 / Internal Notes (For Exporter Compliance File)

> **文档保留 / Document Retention**: 本声明应在供应商商业记录中存档,保留时间不少于本声明项下最后一票货物日期起 5 年。

> This statement should be filed with the supplier's commercial records for not less than 5 years from the date of last shipment under this statement.

> **客户验证 / Customer Verification**: 接受本声明前,出口商应核实:
> Before accepting this statement, exporter should verify:
> - 最终用户在美国注册(通过州商业记录查询) / End user company is registered in the U.S.
> - 最终用户不在 SDN 名单、Entity List 或 Denied Persons List 上 / End user is not on SDN/Entity/Denied Persons List
> - 最终用户有可验证的商业网站或商业存在 / End user has a verifiable business website or commercial presence

> **预警信号 / Red Flags**: 以下情况需要在继续之前进行额外审查:
